Dalbury Lees is an attractive rural settlement about 5 miles west of Derby. The linear settlement includes a village green and a popular pub - The Cow. The three sites lie outside the village boundary but are closely connected to the village sharing a frontage onto Main Road. Two planning applications were made, the first a single plot located between two bungalows and the second a double plot which abutted the village boundary, with a bungalow to the north and a house to the south. All three plots are on agricultural land and all benefit from extensive views towards the Trent Valley.
The applications were made under South Derbyshire’s policies H1 and BNE5. These allow infilling in what is otherwise a built up frontage. Infilling is restricted to areas of land suitable for one or two dwellings only and to be infill you will need to have houses or non-agricultural buildings on both sides of the plot if facing a road. The infill policy applies OUTSIDE of town and village boundaries and is a countryside policy.
The Parish Council objected to both applications and there was an objection from the ward member. The applications went to planning committee in February 2018, the single plot was allowed but the double plot was refused following a tied vote. The reasons for refusal were unclear on the night. However procedures on tied votes were not properly followed and so the application was rescheduled for a decision in March. At the meeting the application was re-considered and approved by 7 votes to 3.
South Derbyshire has a 5 year housing supply and an up to date local plan. Policy BNE5 is part of the Part 2 Plan and has been recently adopted following a Local Plan examination in the spring of 2017. Planning Officers gave strong support for the infill policy as a countryside policy. This opens up the prospect of more small sites being made available for development in smaller hamlets and villages where there is no village boundary.
