Planning & Design Practice are delighted to announce a double success, with planning permission having been granted for the demolition of an agricultural building and the erection of another, on two different sites across Derbyshire and Staffordshire.
The demolition case was facilitated by means of a prior approval planning application. Such applications make use of agricultural landowners Permitted Development rights to demolish buildings. Whereas the erection of the agricultural building, due to the size of the landholding, required full Planning Permission.
In the first case, an eighteenth-century barn, which was no longer suitable for modern agricultural practices, was to be demolished. The barn was sited within a farmstead associated with a Grade II Listed farmhouse and separately Grade II Listed barns on a one-hundred-hectare farm. With this particular barn being separated from the listed buildings, a pre-application was first submitted to understand whether the barn was curtilage listed. After confirmation was received that the barn was not curtilage listed, a prior approval planning application (under Part 11, Class B of the General permitted Development Order 2015) was submitted. Since then, confirmation has been received that the building, which was in a poor state of disrepair could be demolished. Our client, has plans to reuse the stonework to construct an agricultural workers dwelling and use the land the current building stands on to construct a modern agricultural building, better suited to modern farming methods.
The second application related a small holding behind a property in Heage, Derbyshire. In this case, our client wanted an agricultural building on his equestrian landholding. This building would house equipment associated with the upkeep and maintenance of the land. Despite the defined equestrian use of the land (comprised of stabling, a menage and a muck heap) the agricultural building was granted permission.
Both of these approvals have allowed our clients to make better use of their existing land holdings supporting agricultural enterprises and the maintenance of smaller land holdings.
